Terms of Service

1. Who we are

MarketPro (the apps for iOS and Android, the web app at app.getmarketpro.app and the website getmarketpro.app, together the "Service") is operated by:

"MarketPro", "we" and "us" mean Harajuku Holdings LTD. "You" means the person using the Service.

2. Agreeing to these Terms

By creating an account, buying a subscription or otherwise using the Service you agree to these Terms, our Privacy Policy, our Risk Disclosure, our Subscription and Refund Policy and our Eligibility Policy. If you do not agree, do not use the Service. We record which version of these Terms applied when you signed up or bought.

3. Who can use MarketPro

• You must be at least 18 and able to enter into a binding contract.
• Some features, including paid signals, broker links and the cashback programme, are not available in every country. Which features are available where is set out in our Eligibility Policy. We do not advertise or market the Service in the countries listed there as restricted.
• You must tell us your real country of residence when we ask, and keep it up to date if you move. Do not use a VPN or other means to appear to be somewhere else. If your residence, payment details or location show that a feature is not available to you, we may switch that feature off for your account as described in section 21.
• You are responsible for making sure that trading, and using a broker you choose, is lawful where you live.

4. What MarketPro is, and what it is not

How signals are made. Signals are produced by an automated strategy engine that scans gold, silver and major currency pairs using technical rules (for example moving averages, momentum and volatility measures). Each candidate is checked by an AI review, which can reject it, before it is published. Occasionally our team publishes a signal by hand. A signal states a direction, an entry, a stop level, one or more targets, a timeframe and the reasoning behind it.

The same for everyone. Every signal is published identically to every user who can see it. Nothing in a signal is based on your money, goals, experience, positions or circumstances, and we do not ask for them to produce signals.

What MarketPro does not do. MarketPro is not a broker, a bank, an investment adviser, a portfolio manager or a fund. We do not execute trades, place orders, copy trades into your account, hold your money, or have access to any trading account. No automated trading software (Expert Advisor) is currently offered. Any trade is placed by you, with a broker you choose, in your own account.

Other features. The Service also includes lessons, an AI tutor and other AI tools, calculators, market news, an economic calendar, a simulator that uses virtual money only, and a public track record. AI tools generate general explanations; they can be wrong and must not be treated as advice about your own trades.

5. General information, not advice

Everything in the Service, including signals, levels, reasoning, AI answers, lessons and figures, is general information and education. It is not investment advice, a personal recommendation, or an offer or solicitation to buy or sell anything. It does not take account of your circumstances, and it may not be suitable for you. Before trading, consider whether it is suitable for you and, if you are unsure, get advice from an independent adviser licensed where you live. Our team will not tell you whether to take a particular trade or how much to risk.

6. Trading risk

Trading foreign exchange, gold, silver and contracts for difference (CFDs) with leverage carries a high risk of losing money quickly, and you can lose all the money you deposit with a broker (and, with some brokers, more). Most retail CFD accounts lose money. Stop-losses do not guarantee your exit price. Signals can be late, can stop being valid, and many lose. Only trade with money you can afford to lose. The Risk Disclosure forms part of these Terms.

7. Performance figures

Where we publish win rates, pip totals or other results, they are measured from our own signal records at the date shown and are explained on the track record. Unless stated otherwise: a signal counts as a win when it reached its first target; pips are gross and do not deduct spreads, commissions, swaps or slippage; results are per signal, not the result of any real account; and simulator results use virtual money. Your own results will differ, and can be losses even when published results are positive. Past performance is not a reliable indicator of future results.

8. Broker links, commissions and cashback

• We earn commission. MarketPro is a partner (introducing broker) of some brokers, currently Exness and XM. If you open or trade on an account through our links, the broker pays us a commission based on your trading volume. This means we benefit when you trade more, whether you make or lose money. We are not paid more or less depending on whether a particular signal wins.
• You choose your broker. Brokers are independent companies. Your contract, your money and your trades are with the broker, under its terms and its regulator. Check which of its companies would hold your account, and that it may serve you where you live.
• Cashback. Where available, the cashback programme passes part of the broker's commission back to you; the broker pays it into your trading account. The share is higher for paid subscribers, as shown in the app. Cashback is never conditional on how much you deposit. It is not available in every country (see the Eligibility Policy) and can end if the broker ends its arrangement with us.
• Broker links, broker promotions and cashback are switched off in countries where they are not permitted.

9. Your account

Give accurate information, keep your login secure and tell us at once if you think someone else has used it. You are responsible for activity on your account. You can delete your account in the app at any time; see the Privacy Policy for what that deletes. Deleting your account does not cancel a subscription.

10. Subscriptions and payment

Premium is a paid subscription. The price, billing period and any introductory price are shown before you buy. Subscriptions renew automatically at the then-current price for the same period until you cancel.

• Bought in the iOS or Android app: you buy from Apple or Google, who charge your store account, handle renewal and cancellation under their terms, and decide refunds. Cancel at least 24 hours before the period ends in your device's subscription settings.
• Bought on the web (app.getmarketpro.app or getmarketpro.app): payment is processed through Stripe under Stripe Managed Payments, where Link, LLC (a Stripe company) acts as merchant of record and collects any sales tax or VAT. Your purchase appears as "Sold through Link". Your contract for the Service itself is with us. Cancel at any time in the billing portal or from My Account in the web app.
• Cancelling stops the next renewal. You keep Premium until the end of the period you paid for.
• Price changes apply from your next renewal, after notice from us or the store, and you can cancel before they apply.

11. Cancellation, withdrawal and refunds

Our Subscription and Refund Policy explains refunds for each way of paying, including the 14-day right of withdrawal that consumers in the EU, EEA and UK have for web purchases. Outside statutory rights and the store's and Stripe's own policies, we refund only in exceptional cases after reviewing the request. Nothing in these Terms affects your statutory rights.

12. Emails and notifications

We send service messages about your account, security and billing. When you sign up we also send product emails about MarketPro's features, lessons and offers; you can unsubscribe from these with the link in every email or in the app, without affecting your account. Emails about a broker account or cashback request are sent only to people who made that request, as part of handling it; we do not send broker promotions to anyone else. Push notifications and Telegram notifications are sent only if you switch them on.

13. Free features, rewards and referrals

Free signals, points, streaks, referral rewards and promotions are offered at our discretion and can change or end. Unless we say otherwise they have no cash value and cannot be transferred or sold. Broker-paid cashback is governed by section 8, not this section. We may withhold rewards obtained through fraud, fake or duplicate accounts, self-referral or a breach of these Terms.

14. Acceptable use

Do not: use the Service unlawfully; copy, resell, republish or share signals or paid content (including in groups or channels) without our written permission; scrape or automate access; reverse engineer the apps except where the law allows; interfere with the Service or its security; open accounts by automated means or with false details, or misrepresent your country; or infringe anyone's rights.

15. Intellectual property

The Service, including software, signals, text, design and the MarketPro name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use it for your own non-commercial purposes under these Terms.

16. Third parties and market data

The Service depends on third parties, including app stores, payment providers, hosting providers, AI providers and market-data vendors. Prices and charts come from data vendors and can be delayed, revised or differ from your broker's prices; a level shown as reached in the Service may not have been reached at your broker, and the reverse. We are not responsible for third-party services or websites we link to, and your dealings with a broker are between you and the broker.

17. Changes to the Service

We work to keep the Service available, but it can be interrupted, delayed or changed, for example during maintenance, outages of our providers or market-data problems. Notifications may arrive late or not at all. We may change, add or remove features. If we remove a substantial paid feature while you have an active web subscription, you may cancel and we will refund the unused part of your current period.

18. What we do not promise

We provide the Service with reasonable care and skill. Apart from that, and from any guarantees the law gives consumers that cannot be excluded, we do not promise that the Service will be uninterrupted or error-free, that any signal, price or figure will be accurate, complete or timely, or that using the Service will make you money.

19. Limitation of liability

• Trading losses. Signals and other content are general information, and every trading decision is yours. To the extent the law allows, we are not liable for losses from trades you make or do not make, or for lost profits.
• Other loss. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100.
• What we do not limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law, and nothing affects your statutory rights as a consumer.

20. Your responsibility for misuse

If you use the Service in breach of section 14 or the law (for example by reselling signals or using another person's account), you are responsible for the losses and reasonable costs that causes us, to the extent the law allows. This does not apply to your ordinary use of the Service or to your own trading decisions.

21. Suspension and termination

• You can stop using the Service and delete your account at any time.
• We may suspend or close your account if you seriously or repeatedly breach these Terms, if required by law, or to protect the Service or other users. Where reasonable we will tell you first and why.
• If a feature is not available in your country, or you move to such a country, we may switch that feature off for your account. If that ends a web subscription you paid for, we will cancel it and refund the unused part of the current period. For store subscriptions, cancel in the store and ask Apple or Google for a refund; we will support the request.
• If we close the Service entirely, we will give reasonable notice and refund the unused part of any web subscription.
• Sections 5 to 8, 15, 18, 19, 20 and 24 continue after termination.

22. Changes to these Terms

We may update these Terms, for example when the Service or the law changes. For changes that matter to you, we will notify you in the app or by email at least 14 days before they apply, and you can cancel before then. The version and date are shown at the top of this page.

23. Complaints

Email support@getmarketpro.app or open a ticket in the app. We acknowledge complaints within 5 working days and aim to give a full answer within 30 days. If you are a consumer, you can also contact the consumer authority where you live.

24. Governing law and courts

These Terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction. If you are a consumer, this does not take away the protection of the mandatory law of the country where you live, and you may also bring proceedings in the courts there.

25. App Store terms

If you downloaded the app from Apple's App Store: these Terms are between you and us, not Apple; Apple is not responsible for the app or its content and has no obligation to provide support or maintenance for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the extent the law allows, Apple has no other warranty obligation. We, not Apple, are responsible for any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer protection and intellectual-property claims. You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and are not on any US Government list of prohibited or restricted parties. You must comply with applicable third-party terms (for example your mobile carrier's) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Our contact details are in section 1.

26. General

If any part of these Terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these Terms; we may transfer ours to another company that takes over the Service, and that will not reduce your rights. These Terms and the documents listed in section 2 are the whole agreement between us about the Service.
